This excerpt from page 352 of the July 15, 2002 Village Board Minutes clearly shows that the Mayor, Trustees, and the Village Attorney knew well what the board resolution was about.

It was moved by Trustee Miller, seconded by Trustee Mauersberger, who moved its adoption to wit:

WHEREAS, and on July 14, 2000, an action was commenced by Keith Mose, under Index No.:12871100, as against the Village of Freeport and Village employee Donte D. Eley, arising from an automobile accident of April 10, 2000; and,

WHEREAS, the plaintiff had alleged numerous physical injuries as a consequence of said accident; and,

WHEREAS, and as recommended by Bee, Eisman, and Ready, Special Counsel for the Village of Freeport and Village Employee Donte D. Eley, settlement negotiations were held with the attorneys representing Plaintiff Keith Mose, and,

WHEREAS, and in part due to the injuries sustained by the-Plaintiff, and medical reports submitted thereto, the Village's Special Counsel recommended that the matter be settled for an amount not to exceed $600,000.00,

NOW THEREFORE BE IT RESOLVED, that Bee, Eisman & Ready, as Special Counsel to the Village of Freeport, be and is hereby authorized to settle the aforestated action for a not to exceed amount of $600,000.00; and,

BE IT FURTHER RESOLVED, that the Mayor be and is hereby authorized to sign any and all documents to effectuate this settlement.
